1. Acceptance and website use
By using this website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website. You must use the website lawfully and provide accurate information when submitting forms.
Submitting a form, requesting an estimate, scheduling a meeting, or discussing a project does not create a client relationship or require either party to proceed.
2. Services, estimates, and proposals
Kia DeV Studios offers custom software development, business websites, databases, backend and API development, integrations, AI automation, Donna AI Receptionist implementations, creative applications, and Software Care & Maintenance.
Displayed prices are starting points or standard plan prices unless expressly stated otherwise. Final scope, deliverables, exclusions, schedule, fees, third-party costs, support, acceptance criteria, and responsibilities are established in writing. A signed agreement controls if it conflicts with these website Terms.
3. Payments, deposits, subscriptions, and refunds
Payment terms, deposits, milestones, recurring charges, included usage, overages, cancellation, and refund eligibility will be stated in the applicable written agreement or checkout page. A project start date is not reserved until the required agreement is approved and the required deposit or initial payment has cleared.
Payments may be processed by Stripe. You are responsible for accurate billing information and authorized charges. Except where required by law or stated in a written agreement, fees for completed work, reserved capacity, setup, or consumed services are not automatically refundable.
4. Intellectual property
The Kia DeV Studios name, website design, text, graphics, product names, demonstrations, templates, processes, and pre-existing materials are protected by applicable intellectual-property laws and may not be copied, resold, or represented as your work without permission.
Ownership and licensing of custom deliverables, source code, third-party components, reusable tools, data, and client-supplied materials will be defined in the applicable written agreement. Clients must have the right to provide all content, data, credentials, trademarks, and materials supplied for a project.
5. Acceptable use
You may not misuse the website or services; attempt unauthorized access; interfere with security or availability; submit malicious code; violate another person’s rights; use services for unlawful, deceptive, abusive, discriminatory, harassing, or harmful activity; or use Donna or other automated systems to impersonate people or make unauthorized commitments.
6. Third-party services
Projects and this website may use independent hosting, domain, email, telecommunications, AI, analytics, scheduling, payment, database, and messaging providers. Their terms, pricing, availability, and privacy practices are controlled by those providers.
7. Disclaimers and limitations
Services and website content are provided on an “as available” basis to the extent permitted by law. Kia DeV Studios does not promise uninterrupted availability, error-free operation, specific revenue, cost savings, lead volume, search ranking, conversion rate, or other business outcome. Project warranties, remedies, and service levels exist only when stated in a written agreement.
To the extent permitted by law, Kia DeV Studios is not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the public website. Limits for paid services will be stated in the governing agreement. Nothing here excludes rights or liability that cannot legally be excluded.
8. Suspension, changes, and governing terms
Access may be restricted when necessary to protect the website, services, business, clients, or others. We may update these Terms by posting a revised version and date. Governing law, venue, disputes, and termination rights for paid work will be stated in the applicable written agreement.
